Waste Removal Mayfair Service Terms and Conditions
These Terms and Conditions set out the basis on which Waste Removal Mayfair provides waste removal and related services to domestic and commercial customers. By placing a booking, accepting a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, company or organisation requesting services from Waste Removal Mayfair.
Services means waste removal, clearance, collection, loading, transportation, and disposal services provided by Waste Removal Mayfair, including related ancillary services.
Waste means any items, materials, goods, rubbish, refuse, or belongings presented for collection and removal by the Customer.
Agreement means the contract between the Customer and Waste Removal Mayfair formed in accordance with these Terms and Conditions.
2. Scope of Services
Waste Removal Mayfair provides waste removal and clearance services within its designated service area. Services may include household waste collection, office clearance, bulky item removal, garden waste removal, and similar non-hazardous waste collection activities.
All Services are subject to availability and to any restrictions under applicable waste management laws and regulations. We reserve the right to refuse collection of any Waste that is prohibited, unsafe, unlawful to transport, or not as described at the time of booking.
3. Booking Process
3.1 Bookings may be made by telephone, email or other booking channels we may make available from time to time. A booking is an offer by you to purchase Services from us in accordance with these Terms and Conditions.
3.2 At the time of booking, you must provide accurate and complete information about:
(a) the collection address and any access restrictions;
(b) the type, approximate volume and description of Waste to be collected;
(c) any items that may require special handling or additional labour; and
(d) any time constraints, parking limitations, or property rules that may affect the collection.
3.3 We will provide an estimated price or quotation based on the information you supply. This estimate may be revised if, on arrival, the Waste differs in quantity, type or location, or if the work is materially more time consuming or labour intensive than described.
3.4 Your booking is accepted, and a binding Agreement is formed, when we confirm the booking and you accept the quoted charges, either verbally or in writing. We are not obliged to accept any booking request.
4. Service Attendance and Access
4.1 We will use reasonable efforts to attend your premises at the agreed time or within an agreed time window. However, times are estimates only, and we are not liable for minor delays caused by traffic, weather, operational issues or other circumstances outside our reasonable control.
4.2 You are responsible for ensuring safe, lawful and reasonable access to the collection location, including suitable parking or stopping space for our vehicle. Any parking charges, permits or penalties incurred as a direct result of the collection may be added to your invoice.
4.3 If we cannot gain access to the premises or to the Waste at the agreed time for reasons within your control, we may treat this as a late cancellation or aborted visit and apply a call-out charge or cancellation fee.
5. Customer Responsibilities
5.1 You must ensure that:
(a) you are the owner of the Waste or have full authority from the owner to dispose of it;
(b) no valuable, sentimental, confidential, or important items are included in the Waste presented for removal;
(c) the Waste is safely accessible and does not present a risk to health and safety; and
(d) any required permissions from landlords, managing agents, or local authorities are in place.
5.2 You agree to indemnify Waste Removal Mayfair against any claim by a third party alleging that you did not have the right to dispose of the Waste or that any items were removed without proper authority.
6. Pricing and Payment Terms
6.1 Our charges are generally based on the volume of Waste collected, the weight or classification of items, the number of operatives required and the time taken to complete the job. Additional charges may apply for difficult access, heavy materials, or extra labour.
6.2 Unless otherwise stated, all prices are quoted in pounds sterling and may be subject to applicable taxes or statutory charges. Any such charges will be made clear to you before you confirm your booking where reasonably possible.
6.3 Payment is due on completion of the collection, unless we agree alternative terms in writing in advance. We may accept payment by cash, card or other methods we notify to you. For business customers, credit terms may be offered at our discretion, subject to satisfactory checks.
6.4 Where credit terms are agreed, invoices must be paid in full by the due date stated on the invoice. We reserve the right to charge interest and reasonable administration costs on late payments in accordance with applicable UK law.
6.5 If you dispute any part of an invoice, you must notify us promptly with full details. You remain liable to pay any undisputed amount by the due date.
7. Changes to Bookings
7.1 You may request changes to the date, time or scope of your booking by contacting us as early as possible. All changes are subject to our availability and our agreement.
7.2 If you significantly increase the quantity or type of Waste, or the job being requested is materially different from that originally booked, we may provide a revised quotation. If you do not accept the revised quotation, we may cancel the booking without further liability to you.
8. Cancellations and Aborted Visits
8.1 You may cancel your booking free of charge if you provide us with a reasonable period of notice, which we will communicate at the time of booking. Cancellations made with shorter notice may incur a cancellation fee to cover our costs.
8.2 If our team attends the property and is unable to complete the collection due to circumstances within your control, including lack of access, unsafe conditions, or unavailability of an authorised person, we may charge an aborted visit fee.
8.3 We may cancel or postpone a booking at any time if:
(a) we consider it unsafe or unlawful to perform the Services;
(b) you have provided materially inaccurate or incomplete information; or
(c) events outside our reasonable control prevent us from attending.
In such circumstances, we will use reasonable efforts to rearrange the collection but shall not be liable for any loss or inconvenience arising from the cancellation.
9. Waste Types and Prohibited Items
9.1 Waste Removal Mayfair operates in accordance with UK waste management laws and regulations. We cannot collect certain categories of waste, including but not limited to: hazardous chemicals, asbestos, clinical or medical waste, gas cylinders, certain electrical items requiring specialist disposal, and any substances classified as hazardous or controlled without the necessary licenses.
9.2 You must inform us in advance if any Waste may fall into a special or controlled category or may require specific disposal methods. We reserve the right to refuse collection or to apply additional charges where special handling is required or where we must use specialist disposal facilities.
9.3 If prohibited or undeclared hazardous waste is discovered during or after collection, we may take steps to quarantine, return or arrange compliant disposal of the items at your expense. You will be responsible for any fines, costs, or liabilities arising from your failure to disclose such items.
10. Environmental Responsibility and Disposal
10.1 Waste Removal Mayfair aims to manage collected waste responsibly and in compliance with UK environmental legislation. We may use licensed waste transfer stations, recycling facilities and authorised disposal partners.
10.2 Once Waste has been removed from your premises and loaded onto our vehicle, ownership of that Waste transfers to Waste Removal Mayfair or its authorised partners, unless otherwise agreed in writing. We may reuse, recycle, donate or dispose of items at our discretion, in accordance with applicable laws.
10.3 We cannot guarantee that all items will be recycled. However, we will make reasonable efforts to minimise landfill and to follow good environmental practices in our waste collection and disposal activities.
11. Liability and Limitations
11.1 We will provide the Services with reasonable care and skill. If we fail to do so, we may, at our option, either re-perform the Services or provide an appropriate refund for the affected part of the work.
11.2 Our operatives will take reasonable care when working on your premises. You must let us know before we start work if there are any fragile areas, delicate surfaces, or specific risks. We are not liable for fair wear and tear or for minor cosmetic damage reasonably incidental to the proper performance of the Services.
11.3 You must remove or clearly identify any items that you do not want us to take. We are not responsible for loss of items that you leave mixed with the Waste or in areas clearly designated for removal.
11.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.
11.5 Subject to the above, we are not liable for:
(a) any loss of profit, loss of business, or loss of opportunity;
(b) any indirect, special or consequential loss or damage; or
(c) any loss arising from events beyond our reasonable control.
11.6 Our total liability to you in respect of all losses arising under or in connection with the Agreement, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total amount paid by you for the Services giving rise to the claim.
12. Insurance
12.1 Waste Removal Mayfair maintains insurance cover appropriate to its business activities, including public liability insurance, in accordance with industry standards.
12.2 It is your responsibility to ensure that your own property and contents are adequately insured during the provision of the Services. You should inform your insurer if necessary.
13. Complaints
13.1 If you are dissatisfied with any aspect of our Services, you should notify us as soon as reasonably possible. Providing photographs and clear details of your concerns will help us investigate.
13.2 We will review your complaint and aim to respond within a reasonable timeframe. Where we are at fault, we will seek to agree an appropriate remedy, which may include re-performing the Services or providing a partial refund.
14. Data Protection and Privacy
14.1 We may collect and process personal information about you for the purposes of managing bookings, providing Services, processing payments and handling queries or complaints.
14.2 We will handle your personal data in accordance with applicable UK data protection legislation and only retain it for as long as is necessary for our legitimate business purposes or as required by law.
15. Variations and Updates to These Terms
15.1 Waste Removal Mayfair may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings from the date the revised terms are made available. The version in force at the time of your booking will apply to that Agreement.
15.2 No variation to these Terms and Conditions shall be effective unless agreed in writing by an authorised representative of Waste Removal Mayfair.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Removal Mayfair.
17. General Provisions
17.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid or unenforceable, that provision shall be deemed deleted, but the validity and enforceability of the remaining provisions shall not be affected.
17.2 No failure or delay by Waste Removal Mayfair to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
17.3 You may not assign or transfer any of your rights or obligations under the Agreement without our prior written consent. We may assign or subcontract our rights and obligations where this does not materially affect the standard of the Services provided to you.
17.4 These Terms and Conditions, together with any quotation or booking confirmation, constitute the entire agreement between you and Waste Removal Mayfair in relation to the Services and supersede any prior discussions, correspondence or understandings.
